§ 15-28. Definitions.

  • Technical terms used in this act [article] and in the rules and regulations adopted pursuant hereto are those defined in the "Glossary—Water and Sewage Control Engineering" published jointly by the American Public Health Association, American Society of Civil Engineers, American Water Works Association and Water Pollution Control Federation, latest edition, and "The Condensed Chemical Dictionary," published by Reinhold, latest edition. As used in this act [article] and said rules and regulations, the words and phrases shall have the following meaning unless some other meaning is plainly indicated:

    (a)

    Air contaminants shall mean a particulate matter as defined herein, gas or odor, including but not limited to, smoke, charred paper, dust, soot, grime, carbon or any other particulate matter, or irritating, malodorous or noxious acids, fumes or gases, or any combination thereof, but shall not include uncombined water vapor.

    (b)

    Air pollution shall be construed to mean the presence in the outdoor atmosphere of one (1) or more air contaminants or combination thereof in such quantities and of such duration as to be injurious to human, plant or animal life, or property, or which unreasonably interferes with the comfortable enjoyment of life or property, or the conduct of business.

    (c)

    Waste discharge shall mean any outfall, ditch, pipe, soakage pit, drainage well, drainfield or any other method or device by which treated or untreated sewage, industrial wastes or other wastes can enter the surface waters or groundwaters, so as to cause water pollution as herein defined.

    (d)

    Water pollution shall mean the introduction in any surface or underground water, of any matter or deleterious substance in such quantities, proportions or accumulations which are injurious to human, plant, animal, fish and other aquatic life or property, or which unreasonably interferes with the comfortable enjoyment of life or property or the conduct of business.

    (e)

    Compliance tests shall mean tests made to determine compliance with the provisions of this act [article] and the rules and regulations promulgated hereunder.

    (f)

    Commission shall mean the Orange County Environmental Protection Commission established pursuant to this act [article].

    (g)

    Rules and regulations shall mean rules and regulations adopted pursuant to this act [article].
