§ 15-116. Discovery, reporting, and mitigation of discharges.

  • (a)

    In the event of an accidental illicit discharge, the owner or operator of industrial or commercial facilities or construction sites shall notify the Orange County environmental protection division of the discharge within twenty-four (24) hours of its discovery and report the apparent nature and scope of the discharge.

    (b)

    Any person responsible for an illicit discharge or illicit connection shall immediately, upon notification or discovery, initiate procedures to cease discharging and implement suitable BMPs. Such procedures shall include seeking to obtain approval from the environmental protection officer of a schedule for implementing proposed corrective measures. Implementation of such procedures or containment shall not relieve violators of liability for illicit discharge or illicit connection under this article. Failure to undertake such procedures promptly upon discovery or notification shall be a violation of this article.
