§ 15-366. Remedies.

  • In any case where activity occurs without the permit required by this article, or in violation of any conditions of this permit, the county may, without limitation:

    (1)

    Seek injunction from any court of competent jurisdiction against the continuation of the violation.

    (2)

    Seek a mandatory injunction to compel the restoration of lands to the condition in which they existed prior to violation.

    (3)

    Recover damages for the loss of habitat units, which shall be paid to the conservation trust fund.

    (4)

    Prosecute the violator before the code enforcement board of the county who may assess fines.

    (5)

    Pursue any other remedy now or hereafter provided by law.
