§ 16-5. Waivers.

  • Upon written application which may be included with permit applications under this chapter, the board of county commissioners may grant waivers from the regulations contained in this chapter. The applicant for any waiver shall demonstrate and the board of county commissioners shall consider any one (1) or more of the following factors with respect to any application for waiver:

    (1)

    Location of the real property.

    (2)

    Distance of the proposed operation from improvements on adjoining real property.

    (3)

    Effect of proposed waiver on adjoining real property.

    (4)

    Current physical conditions on the real property.

    (5)

    Whether the waiver would be contrary to the public health, safety and welfare.

    (6)

    Any special conditions applicable to the real property.

    (7)

    Whether the waiver would nullify the intent and purpose of this chapter.
