§ 16-22. Permit procedures.
(a)
The applicant shall submit a properly executed application form with all required supporting documents to the county engineer. Supporting documents for origination or renewal include, but are not necessarily limited to:
(1)
Processing fee.
(2)
Letter of credit or other surety to guarantee repair of damages, completion, restoration, and final submission of the required certified contoured (one-foot intervals) topographic survey.
(3)
Dust abatement plan.
(4)
Owner's consent, if the application is made by any person or firm other than the owner of the property involved.
(5)
Four (4) copies of a current certified boundary and topographic survey, prepared by a land surveyor registered in the State of Florida, including a location sketch. For purposes of this article, a current survey shall mean a survey which has been certified within six (6) months of the date of submittal of a permit application. Topography shall extend a minimum of one hundred fifty (150) feet beyond the top of bank of excavation or toe of slope of stockpile and shall include:
a.
All improvements within this area, including type and location of proposed security fence to be installed;
b.
Contours of one-foot interval;
c.
Volume of excavated or stockpile material;
d.
Areas to be used for stockpiling overburden;
e.
Phase lines; and
f.
Final grading plan.
(6)
Normal wet and dry season groundwater elevations as determined by a geotechnical/soils engineer as defined in chapter 34, pertaining to subdivisions.
(7)
Four (4) copies of a certified dewatering plan if excavation is to be below the normal wet season groundwater elevation. Dewatering plans shall be designed so as to ensure the applicant prevents any water quality violations in receiving waters and shall include, but are not necessarily limited to:
a.
Points of discharge.
b.
Pumping rates.
c.
Drawdown curve (cone of depression).
(8)
Location, depth and extent of the following soils:
a.
Rutlege Mucky Fine Sand (Rc), Sanibel Muck or Basinger f.s. (42 or 3).
b.
Brighton Mucky Peat (Bj, Bk, Bl, Rm).
c.
Everglades Mucky Peat (Ed, Ee, Ef, Ec).
d.
Freshwater Swamp (Fs), Samsula-Hontoon-Basinger (41).
e.
Pamlico Muck (Pa), Samsula Muck (40).
(9)
Four (4) copies of a plan for restoration and revegetation, indicating phase lines.
(10)
Four (4) copies of an erosion and turbidity control plan.
(11)
Upon request of the county engineer, four (4) certified copies of a traffic control plan.
(b)
Permits issued under the provisions of these regulations shall become null and void if the permit is not picked up from the county engineer's office within forty-five (45) days after approval of the application by the county.
(c)
Permits shall be available at the job site at all times.
(d)
Annual permits expire one (1) year from the date of approval unless otherwise directed by the board. Thirty-day permits expire one (1) month from commencement of work.
(e)
Annual permits may be renewed and reissued provided the current operation is in accordance with the construction plans and phase lines, and provided restoration is proceeding in accordance with the approved plans. The permit holder shall submit written request for renewal of a permit with supporting documents at least sixty (60) days prior to the expiration of the permit.
(f)
Permits may be transferred upon payment of a service charge as prescribed by the board of county commissioners.
(g)
Soil-cement batch plants that are to be part of an approved excavation site will be required to have construction plans submitted to the county engineer at the time of the applicants' excavation permit application. Plans shall include a site plan which identifies location of the plant, storage area of materials, drainage plan, and access.
(h)
Notification of planned commencement of operations must be made to the county engineer twenty-four (24) hours prior to such commencement.
