§ 17-339. Resolution; public inspection of documents.

  • (a)

    To defray in whole or part the costs of any capital projects by either specially assessing benefited property or by issuing special assessment bonds which pledge the revenues from special assessments, the board of county commissioners shall prepare a written resolution setting forth the following:

    (1)

    The nature, location and estimated cost of the proposed capital project;

    (2)

    The portion of capital costs to be paid from the proceeds of special assessments or special assessment bonds;

    (3)

    The manner of assessing specially benefited property;

    (4)

    The number of annual installments by which the assessments are payable and the maximum rate of interest which the assessments will bear;

    (5)

    A description of the lands upon which the assessments will be imposed;

    (6)

    The proposed assessment for each benefitted property; and

    (7)

    Any special provisions pertaining to the MSTU.

    (b)

    After preparation of the resolution, the board of county commissioners shall make available for public inspection at the offices of the appropriate county department:

    (1)

    A copy of the proposed resolution; and

    (2)

    A copy of the plans and specifications for the capital projects, either preliminary or final.
