§ 17-342. Notice of public hearing.

  • (a)

    The board of county commissioners shall fix a time and place at which interested persons may appear and be heard by the board as to:

    (1)

    The desirability of undertaking the capital project;

    (2)

    The desirability of defraying the cost through such special assessments or special assessment bonds;

    (3)

    The amount by which each lot or parcel of real estate in the MSTU will be benefited by the capital project; and

    (4)

    The amount to be assessed against each benefited property.

    (b)

    The board of county commissioners shall publish the proposed resolution or a summary thereof, together with a notice of the time and place for the public hearing, in a newspaper of general circulation in the county no earlier than thirty (30) nor later than fourteen (14) calendar days before the hearing. This notice shall also be mailed to owners of property to be assessed at their last known address, and for such purposes the board of county commissioners may rely on the records of the county property appraiser.
