§ 18-2. Enforcement of state fire safety law.

  • The legislature of the state, under the authority of F.S. ch. 633, has authorized the state department of financial services and the state fire marshal to make firesafety rules and regulations concerning various occupancies and processes, procedures and uses. Further, the legislature has provided that such state fire safety laws, rules and regulations be enforced by county fire departments in the same manner as county fire safety ordinances. The following provisions are made to effectuate the intent of the legislature in these matters:

    (1)

    The personnel of the county division of fire rescue department shall enforce all state fire safety statutes and all fire safety provisions of the Florida Administrative Code and any and all other state rules prescribed by the state fire marshal pursuant to F.S. § 633.13. Such enforcement shall be in the same manner as the enforcement of county ordinances and the county's fire safety rules and regulations. Such state statutes, rules and regulations shall be enforceable within the courts of this county in the same manner as county ordinances, rules and regulations.

    (2)

    State fire safety statutes, fire safety provisions of the Florida Administrative Code and any and all other state fire safety rules and regulations prescribed by the state fire marshal pursuant to law shall be enforceable before the county code enforcement board in the same manner as county codes and ordinances enforced pursuant to section 11-33 of this Code.
