§ 19-91. General standards.

  • All development sites, including new construction and substantial improvements, in all areas of special flood hazard shall be reasonably safe from flooding and shall comply with the following provisions:

    (1)

    Anchoring—New construction and substantial improvements. All new construction and substantial improvements shall be designed or modified and adequately anchored to prevent flotation, collapse or lateral movement of the structure resulting from hydrodynamic and hydrostatic loads, including the effects of buoyancy.

    (2)

    Same—Manufactured homes. Manufactured homes shall be anchored to prevent flotation, collapse or lateral movement. Methods of anchoring may include, but are not limited to, use of over-the-top or frame ties to ground anchors. This standard shall be in addition to and consistent with applicable State of Florida requirements for resisting wind forces. Specific requirements shall be that:

    a.

    Over-the-top ties be provided at each of the four (4) corners of the manufactured home with two (2) additional ties per side at intermediate locations and manufactured homes more than fifty (50) feet long requiring one (1) additional tie per side;

    b.

    Frame ties be provided at each corner of the manufactured home with five (5) additional ties per side at intermediate points and manufactured homes more than fifty (50) feet long requiring four (4) additional ties per side; and

    c.

    Any additions to the home be adequately anchored.

    (3)

    Construction materials and methods:

    a.

    All new construction and substantial improvements shall be constructed with materials and utility equipment resistant to flood damage.

    b.

    All new construction or substantial improvements shall be constructed by methods and practices that minimize flood damage.

    (4)

    Utilities:

    a.

    Electrical, heating, ventilation, plumbing, air conditioning equipment, and other service facilities, including duct work, shall be designed and/or located so as to prevent water from entering or accumulating within the components during conditions of flooding.

    b.

    All new and replacement water supply systems shall be designed to minimize or eliminate infiltration of floodwaters into the system.

    c.

    New and replacement sanitary sewage systems shall be designed to minimize or eliminate infiltration of floodwaters into the systems and discharges from the systems into floodwaters.

    d.

    On-site waste disposal systems shall be located and constructed to avoid impairment to them or contamination from them during flooding.

    e.

    Unless a variance has been granted, any alteration, repair, reconstruction, or improvements to a structure which is in compliance with the provisions of this chapter shall meet the requirements of "new construction" as contained in this chapter.

    (5)

    Encroachments. The cumulative effect of any proposed development shall not adversely affect the area of special flood hazard. This determination is to be made in accordance with subsection 19-68(1)(d).

    (6)

    Alterations, repairs, reconstruction or improvements. Any alteration, repair, reconstruction or improvements to a structure that is not in compliance with the provisions of this chapter, shall be undertaken only if said nonconformity is not furthered, extended, or replaced.

    (7)

    Permits. All applicable additional federal, state, and local permits shall be obtained and submitted to the floodplain administrator along with the application for floodplain permit. Copies of such permits shall be maintained on file with the floodplain permit.

    (8)

    Compensating storage. Compensating storage shall be provided for all development within the area of special flood hazard. The flood-storage capacities shall not be adversely affected. Such compensating storage shall be within the same watershed and shall be provided on the same property or at an alternate site if prior approval by Orange County is obtained. For those projects subject to the Orange County Subdivision Regulations, chapter 34, Orange County Code, the floodplain administrator shall coordinate with the county engineer.

    (9)

    Subdivision proposals and other new proposed development (including manufactured homes):

    a.

    Such proposals shall be consistent with the need to minimize flood damage;

    b.

    Such proposals shall have public utilities and facilities such as sewer, gas, electrical, and water systems located and constructed to minimize or eliminate flood damage; and

    c.

    Such proposals shall have adequate drainage provided to reduce exposure to flood hazards.

    (10)

    Partial location in special flood hazard area. When proposed new construction and substantial improvements are partially located in an area of special flood hazard, the entire structure shall meet the standards for new construction.

    (11)

    Location in multiple flood hazard risk zones. When proposed new construction and substantial improvements are located in multiple flood hazard risk zones or in a flood hazard risk zone with multiple base flood elevations, the entire structure shall meet the standards for the most hazardous flood hazard risk zone and the highest base flood elevation.

    (12)

    Base flood profile. All development within areas of special flood hazard shall be designed to maintain the flood carrying capacity of any riverine system such that the base flood elevations are not increased, either upstream or downstream. However, the floodplain administrator may approve an increase of up to one (1) foot in the base flood profile if the applicant can satisfactorily demonstrate that such increase in the flood profile will not adversely affect upstream or downstream property. For those projects subject to the Orange County Subdivision Regulations, chapter 34, Orange County Code, the floodplain administrator shall coordinate with the county engineer.
