§ 21-3. Uniform numbering system.

  • The board of county commissioners is hereby authorized to assign official numbers to buildings which are situated in the county but are not within the corporate limits of any incorporated city or town, for the purpose of providing systematic numbers for addresses and the convenience of the public.

    (1)

    Definitions. For the purpose of this section, the following terms, phrases and words shall have the meanings given herein unless the context indicates otherwise:

    a.

    Accessory building shall mean a building which is clearly incidental or subordinate to and customarily in connection with the principle building and which is located on the same lot with such principle building.

    b.

    Building shall mean any permanent structure designed or built for the support, enclosure, shelter or protection of persons, animals, chattel or property of any kind, including residential, commercial and industrial buildings, but excluding accessory buildings.

    c.

    Building front shall mean that area of the building which faces the public or private street by which the building was numbered.

    d.

    Occupant shall mean any person, association, partnership, trust, organization or corporation, other than the owner, who is occupying or leasing the property for a period exceeding thirty (30) days.

    e.

    Owner shall mean any and all persons, partnerships, trusts, organizations or corporations which own the fee title to the property in question or have an undivided interest therein.

    f.

    Private street shall mean any thoroughfare used for vehicular traffic which is not a public street; to include, but not be limited to, roadways in apartment, condominium or office complexes.

    g.

    Public street shall mean the area of the public right-of-way, either paved or unpaved, which is intended for vehicular traffic, excluding service entrances or driveways.

    (2)

    Assignment of building numbers. The county zoning director shall be responsible for issuing all new building numbers in conformity with the grid numbering system adopted by the board of county commissioners. The zoning director shall be responsible for investigating and inspecting all existing building numbers to insure compliance with this section and shall also be responsible for giving notice to owners and occupants whose current property addresses conflict with the adopted grid numbering system.

    (3)

    Establishment of county grid numbering system. A grid numbering system shall be used for the assignment of street addresses. The system is based on a zero base point located at Central Boulevard and Orange Avenue within the City of Orlando and proceeding outward on a horizontal and vertical axis.

    a.

    The numbers shall increase north and south from Central Boulevard and east and west from Orange Avenue.

    b.

    The numbers shall be assigned to buildings as determined by the grid system and approved by the zoning director.

    c.

    Odd numbers will be issued to the buildings on the north and east sides of the public or private street. Even numbers will be issued to the buildings on the south and west sides of the public or private street.

    d.

    The assignment of numbers on corner lots shall be determined from the public or private street on which the building fronts.

    e.

    In cases in which the public or private street runs both north/south and east/west, the grid direction shall be determined by the proportional length of the public or private street.

    Variations from this grid system may be made by the zoning director when it would be more reasonable or practical to assign a street address based on a grid numbering system used by a municipality in close proximity to the property or building.

    (4)

    Posting of numbers on buildings. All buildings shall have the assigned building number properly displayed, whether or not mail is delivered to the building. The posting of the building number shall be the responsibility of both the owner and occupant of the building and shall comply with the following requirements:

    a.

    The building number shall be affixed to the front of the building or to a separate structure in front of the building, such as a mailbox, post, wall or fence, so that it is visible and legible from the public or private street on which the building fronts.

    b.

    The number shall be in arabic numerals unless otherwise approved by the zoning director. Decorative numbers or other numbers that are difficult to read will not be approved.

    c.

    The numbering shall be of a weather-resistant material permanently affixed to the front of the building or structure.

    d.

    The building numbers shall not be less than three (3) inches in height and shall be of a color that will contrast with the immediate background material.

    e.

    The numbering of all existing buildings shall be brought into compliance with this section within sixty (60) days after notice is given to the owner and occupant of the building's noncompliance with the section.

    f.

    A property owner or his agent shall have the responsibility for contacting the county zoning department to determine the correct building number or numbers to be assigned to all buildings located or constructed on his property in the unincorporated area of the county after the effective date of this section. The owner or his agent shall post the building number in accordance with this section prior to the building's occupancy. A certificate of occupancy shall not be issued until the zoning director has verified that the building has been properly numbered in accordance with this section.

    (5)

    Change of address. The following regulations are established for the notification of change of address:

    a.

    Where the existing building number does not conform to the requirements provided by this section, the zoning director shall provide a change of address notice to the owner and occupant of the building. A building number shall be considered nonconforming if it does not conform with the grid numbering system adopted by the board of county commissioners, if the number is out of sequence with other numbers on the street, or if an odd or even number is on the wrong side of the street.

    b.

    A change of address notice shall contain the following:

    1.

    The correct building number and a requirement that the property owner and occupant post the number in accordance with the requirements of this section within sixty (60) days from the date of the notice.

    2.

    The name of the person notified.

    3.

    The date of the notice.

    A copy of the change of address notice shall be kept on file in the county zoning department.

    c.

    Within sixty (60) days from the date of the notice of change of address, the owner and occupant of the property shall conform the building number to the requirements of this section.

    (6)

    Appeals. If any owner or occupant is aggrieved by the zoning director's determination of street address or building number, he shall have the right to request a review of such determination within thirty (30) days from the date the notice of change of address or other request for conformance is issued by the county zoning director. The zoning director shall review his determination within thirty (30) days from the date of the request for review and shall notify the owner or occupant of his determination in writing. The owner or occupant shall comply with the zoning director's determination unless, within fifteen (15) days from the date of such determination, the owner or occupant files a written request for review by the board of county commissioners. Such request shall be in writing and directed to the county zoning director. The board of county commissioners shall schedule a hearing on the matter and shall notify the owner or occupant of the date and time of the hearing. The owner or occupant shall have the right to appear at the hearing and present evidence and argument in support of his request. After the hearing, the board of county commissioners shall make a determination on the matter, which determination shall be final.

    (7)

    Enforcement. Violations of this section shall be punished as provided in section 1-9. The board of county commissioners may seek whatever remedy, whether in law or equity, is available to it to enforce the provisions of this section. If the numbering of a building or buildings is not brought into compliance with this section within sixty (60) days from the date of the notice of change of address issued by the zoning director, notice of such failure shall be given to the postal authorities by the county.
