§ 21-143. Participation of property within municipal limits.

  • When any part of a highway or street to be improved under this article, whether a side thereof or an end or ends thereof or any other portion thereof, lies in part within the limits of an incorporated city or town, the board of county commissioners shall nevertheless be authorized to make such improvement of the part lying within such city or town and to provide for assessing and paying the cost thereof as herein provided if the governing body of such city or town shall, by resolution or ordinance, consent to the adoption and confirmation of the resolution passed or to be passed by the board of county commissioners ordering the improvement.
