§ 25-1. Sale of goods in vicinity of civic/convention center prohibited.

  • (a)

    Authority and purpose. This section is enacted pursuant to the home rule powers of the county (Fla. Const. art. VIII, § 1(g) and F.S. ch. 125). Its purposes are to protect the health and safety of persons in the county by reducing congestion and traffic in the vicinity of the Orange County Civic/Convention Center ("civic center") and to protect the rights of owners of property in the vicinity of the civic center.

    (b)

    Findings and declarations. The board of county commissioners makes the following findings and declarations:

    (1)

    In preparing to open its new civic center, the board of county commissioners has employed persons with substantial experience in the operation of civic and convention facilities and has consulted extensively with civic/convention facility experts. The board of county commissioners and its staff have also visited numerous convention and civic facilities around the country, observed their operations, and sought the advice of their staffs.

    (2)

    A substantial problem for the efficient and orderly operations of a civic or convention facility is that of unauthorized sales of merchandise in the vicinity of the facility, whether such sales occur on private or public property or on the public right-of-way. Such unauthorized sales can significantly increase the hazards of traffic and pedestrian congestion and can result in the derogation of private property rights.

    (3)

    For the protection of the public health and safety and to ensure the rights of owners and tenants of private property, such unauthorized sales should be prohibited.

    (c)

    Certain sales prohibited. The following sales are prohibited in the vicinity of the civic center:

    (1)

    It is unlawful to sell or to offer to sell any goods, merchandise, wares, or other items of any kind within the right-of-way of International Drive in the county, from the centerline of the right-of-way of Sand Lake Road to the centerline of State Road 528 (Martin Anderson Bee Line Expressway) without the written permission of the director of the civic center.

    (2)

    It is unlawful to sell or to offer to sell any goods, merchandise, wares, or other items of any kind within the rights-of-way of those county roads known as Hawaiian Court and Jamaican Court without the written permission of the director of the civic center.

    (3)

    It is unlawful to sell or to offer to sell any goods, merchandise, wares, or other items of any kind on the site of the civic center without the written permission of the director of the civic center. For purposes of this section, the site of the civic center is all property owned now or in the future by the county and used for civic center purposes.

    (4)

    It is unlawful to sell or to offer to sell any goods, merchandise, wares, or other items of any kind on any private property within that area surrounding the civic center and platted as the several units of "Plaza International," unless such sales or offers of sale are made with the express permission of the owner or tenant of such private property.

    (d)

    Injunctive relief. In addition to any other means of enforcement under state law, the board of county commissioners is entitled to obtain injunctive relief from violations of this section without the necessity of showing irreparable harm.
