§ 25-27. Definition and criteria.

  • (a)

    Definition. Garage sale shall, for the purposes of this article, mean the sale of old, used, or unwanted household articles and other personal items displayed or offered for sale on a lot, parcel, or tract of land in any area not within a zoning district which would permit the retail or wholesale of such articles or items, nor similar commercial operations, and includes garage, yard, estate, or other similar type sales; provided, that the casual sale of household articles and personal items shall not be considered a garage sale where such sale shall be advertised by means other than by signs or posters on or near the premises where such sale is conducted as long as such articles and items are kept and displayed solely within the interior of those premises.

    (b)

    Criteria. Garage sales shall adhere to the following criteria:

    (1)

    Only the personal household items and articles of persons living in the residence where the sale is conducted shall be sold, except for neighborhood sponsored or collaborative garage sales amongst neighbors.

    (2)

    Parking shall be controlled by the persons conducting the garage sale. No vehicles shall obstruct the driveways of other homes in the neighborhood/subdivision.

    (3)

    Auctions, auctioneers, mobile food trailers, or food vendors are prohibited, except in conjunction with community/neighborhood sponsored garage sales conducted at community facilities (such as community centers, common areas, churches and schools), and as specifically authorized by the zoning manager. A written request for such activities shall be submitted to the zoning manager at least forty-five (45) calendar days prior to the scheduled garage sale and the zoning manager shall respond in writing within fifteen (15) calendar days. The organization sponsoring the garage sale shall submit sufficient documentation and will be responsible for ensuring the activities will not have an adverse impact on the surrounding community/neighborhood. Any appeal regarding the zoning manager's decision on a permit for a community/neighborhood sponsored garage sale shall be processed in accordance with section 30-43(1).

    (4)

    The use of public address systems or electronic sound devices, such as but not limited to, speaker phones, loud speakers, etc., are prohibited.

    (5)

    The parking of commercial vehicles, such as but not limited to, tractor trailers, semi-trailers, long bed trucks, etc., shall be prohibited in the residential boundaries where the sale is conducted.

    (6)

    The shipping or delivery of products, equipment, or articles, to the sale site shall be prohibited.

    (7)

    Through traffic on public roadways shall not be obstructed.

    (8)

    Trespassing on adjacent properties without proper authorization from the adjacent property owner is prohibited.
