§ 26-4. 911 emergency telephone system fee.

  • (a)

    Short title. This section shall be known as the "911 Emergency Telephone System Fee Ordinance."

    (b)

    Applicability. This section shall apply throughout the territorial limits of the county and the fees provided for herein shall be imposed upon all local telephone exchange subscribers located therein.

    (c)

    Definitions. As used in this section, the following definitions shall apply:

    (1)

    911 emergency telephone system fee shall mean that fee authorized to be imposed by county governments pursuant to F.S. § 365.171(13), or successive statutory language.

    (2)

    Telephone company shall mean an exchange telephone service provider certified to provide exchange service within Orange County, Florida, and providing 911 emergency telephone service access within Orange County, Florida.

    (d)

    911 fee established. There is hereby established a fee which may be imposed by resolution of the board of county commissioners in an amount up to fifty cents ($0.50) per month per line (up to a maximum of twenty-five (25) access lines per account bill rendered) to be paid by the local subscribers within the county served by the 911 emergency telephone system. Such fee shall serve as reimbursement for recurring and nonrecurring charges for the operation and maintenance of 911 service features and/or public safety answering point (PSAP) equipment, as defined in the state public service commission's lawfully approved 911 and related tariffs and/or 911 equipment, including ANI controllers, ALI controller, ANI display, ALI display, key equipment, teleprinters, automatic call distributors (ACD), ALI data base information, logging recorders, and instant playback recorders, and recurring and nonrecurring charges for the operation and maintenance of such service and such or similar equipment.

    (e)

    Method of payment. Telephone companies (exchange telephone services) providing 911 service access or equipment to the county are hereby requested to spread the payment of the recurring and nonrecurring charges for operation and maintenance of such service and equipment over such period as the 911 emergency telephone service is in operation insofar as is practical, and bill the 911 fees assessed herein to the local exchange subscribers served by the 911 emergency telephone system within the county, on an individual access line basis, at a rate to be established by resolution of the board of county commissioners of up to fifty (50) cents per month per line (up to a maximum of twenty-five (25) access lines per account bill rendered).

    (f)

    Manner of collection and administrative expense. Telephone companies collecting the fee established and imposed by this section shall remit monthly all fees imposed and collected by this section to the board of county commissioners, less an administrative fee equal to one (1) percent of the fees so collected each month.
