§ 2-91. Deferred compensation plan for county officials.

  • (a)

    Established. There is hereby adopted and initially established a deferred compensation program for the following Orange County elected officials and their employees, as defined in F.S. § 112.215: board of county commissioners, clerk of courts, comptroller, property appraiser, supervisor of elections and tax collector. These elected officials and their employees are hereby authorized to participate in such deferred compensation plans as may be subsequently approved and administered in accordance with the provisions of this ordinance.

    (b)

    Duties of comptroller. The county comptroller is hereby designated as the official of the county who with the concurrence of the board of county commissioners shall be responsible for the approval and administration of a deferred compensation plan (the "plan administrator").

    (c)

    Duty of board of county commissioners. The board of county commissioners is hereby designated as the body to be satisfied as to the appropriate taxable status of any income deferred by a deferred compensation plan.

    (d)

    Advisory committee. The advisory council created pursuant to Ordinance No. 76-5 is hereby renamed the deferred compensation advisory committee and shall be composed of at least five (5) members all of whom shall be employees of the county or its elected officials and who shall be appointed pursuant to an interlocal agreement among the county and the other elected officers participating in the deferred compensation plan. The advisory committee shall provide assistance in the administration of the plan to the plan administrator relating to the provisions of the plan, including but not limited to investment options to be offered by the plan, and any and all other matters deemed necessary to carry out the provisions of the plan; provided that the advisory committee shall act in an advisory capacity only.

    (e)

    Prior plans. Prior deferred compensation programs and plans approved by the board of county commissioners for any of its employees are hereby ratified and confirmed and shall continue in full force and effect.
