§ 2-95. Payment of bonus payments to employees and officers.

  • (a)

    Purpose. This section is enacted to authorize the board of county commissioners to create by county administrative regulation a lump sum bonus program whereby the board of county commissioners may authorize by motion and affirmative vote thereon the payment of a lump sum bonus to be paid to outstanding employees of the board of county commissioners and the funding of such a lump sum bonus payable to the employees of the several constitutional officers of the county, either singly or as a group, upon satisfaction of such terms and upon such conditions as may from time to time be set forth in such administrative regulations.

    (b)

    Provisions of administrative regulations. Such administrative regulations as may be enacted pursuant to this section shall provide among other things:

    (1)

    The board of county commissioners, by motion and affirmative vote thereon, may authorize the payment of a lump sum bonus to employees of the board of county commissioners, or the funding of such a lump sum bonus payable to the employees of any one (1) of the constitutional officers of the county, or both, in recognition of outstanding occupational efforts in response to programs, goals or performance objectives articulated from time to time by the county chairman, the board of county commissioners or each or all of the constitutional officers of the county.

    (2)

    Such lump sum bonuses shall not be included in an employee's regular base rate of pay and may not be carried forward in subsequent years.

    (3)

    Such lump sum bonuses shall be payable only to permanent full-time employees who were employed by the county or its constitutional officers upon the last day of any particular county fiscal year and who are so employed upon the date of distribution of such lump sum bonus payment, or in the alternative, such lump sum bonuses may be paid as a reward for employee response to such particularized incentive programs as the board of county commissioners from time to time may authorize through appropriate administrative regulations.

    (4)

    The payment of such bonus to any employee shall not create an expectancy of the payment of any such bonus at any time to any employee in the future. The board of county commissioners shall retain sole discretion to authorize bonus payments, dependent upon budgetary constraints and the fiscal prudence of such bonus payments.
