§ 2-304. Declaration of state of local emergency; duration; alteration and rescission.

  • (a)

    Declaration. A state of local emergency shall be declared by executive order when a promulgating authority finds pursuant to F.S. § 252.38(3)(a)(5) that a local emergency has occurred or that the threat thereof is imminent.

    (b)

    Duration. The initial duration of any state of local emergency declared shall be seven (7) days. When necessary, a state of local emergency may be extended by executive order in seven (7) day increments or less.

    (c)

    Alteration, rescission. Any declaration of a state of local government emergency may be altered or rescinded either by the issuance of a subsequent executive order or by an appropriate resolution of the board of county commissioners.
