§ 2-210. "Sunset" of advisory boards.

  • The MMRB shall prepare and submit to the board a list of the advisory boards and each advisory board's sunset date for approval by the board no later than April 30, 1992. Each advisory board shall sunset as of the date indicated on the approved list unless (i) the board adopts or readopts an enabling resolution for the advisory board before the sunset date and (ii) such enabling resolution specifies a second date no later than the sixth anniversary of the sunset date shown on the approved list, on which second date the particular advisory board shall again sunset unless revived by the board by readoption of the enabling resolution. Notwithstanding the sunset schedule, the board may sunset an advisory board at any time upon a four-sevenths ( 4/7 ) vote of the board.

    At a meeting to be held not later than sixty (60) days before the sunset date of an advisory board, the MMRB shall review the advisory board and make a recommendation to the board on whether to extend the existence of the advisory board or to allow it to sunset. The MMRB shall use in its review of the advisory board such information as it deems pertinent and shall base its review on the following criteria:

    (1)

    Whether the advisory board is serving the purpose for which it was created;

    (2)

    Whether the advisory board is serving a current need of the county;

    (3)

    A list of the advisory board's accomplishments;

    (4)

    Whether there is another public or private board that would better serve the function of the advisory board;

    (5)

    Whether the resolution creating the advisory board should be amended to enable the advisory board to serve better the purpose for which it was created;

    (6)

    Whether the advisory board's membership requirements should be modified;

    (7)

    The direct and indirect costs of maintaining the advisory board.
