§ 2-253. Post-court-ordered mediation.

  • For those real property acquisition negotiations which occur subsequent to court-ordered mediation, but prior to jury trial, the following departmental personnel are designated as Orange County's corporate representatives to participate in the negotiations:

    (1)

    Manager or assistant manager of real estate management department;

    (2)

    The division director, assistant division director, manager or assistant manager of user division/department; and

    (3)

    The assistant county attorney assigned the responsibility for the value portion of the condemnation suit.

    These corporate representatives designated to attend mediations shall have binding settlement authority on behalf of Orange County in amounts up to five hundred thousand dollars ($500,000.00). All settlement approvals must be unanimous and based upon the criteria that settlement is necessary, practical and in the best economic interests of Orange County. Any settlements agreed to by the corporate representatives in exceess of five hundred thousand dollars ($500,000.00) shall be tentative only and must be ratified by the board of county commissioners.
