§ 2-257. Attorneys' fees and costs.

  • Payment of reasonable attorneys' fees and costs incurred by the condemnee may be approved by joint concurrence of the assistant county attorney assigned to the case and the user department designee. Such concurrence shall be granted only after submission to and review by the pertinent county personnel of detailed invoices or, in the case of attorneys' fees, affidavits regarding such fees and costs. Such affidavits and invoices shall be in the form customarily submitted to a court of competent jurisdiction which would make an award in such matters. Failing such concurrence, the issue of fees and costs shall be referred to the circuit court for final determination.
