§ 2-429. Oversight board members.

  • (a)

    Composition; nomination and appointment of members. The oversight board shall be composed of seven (7) voting members plus the comptroller, who shall serve "ex officio," but shall not vote. The voting members of the oversight board shall be as follows:

    (1)

    One (1) professional engineer licensed by the State of Florida within five (5) years of the date of appointment;

    (2)

    One (1) planner certified by the American Institute of Certified Planners who has been nominated by the mayor of Orlando;

    (3)

    One (1) certified public accountant licensed by the State of Florida within five (5) years of the date of appointment;

    (4)

    One (1) member nominated by a citizens' "watchdog" organization selected as a nomination source by the board of county commissioners, such as OCHA, County Watch or the League of Women Voters;

    (5)

    One (1) attorney who is admitted to practice law in the State of Florida;

    (6)

    One (1)member nominated by a state chartered environmental organization selected as a nomination source by the board of county commissioners; and

    (7)

    One (1) member with experience in transportation construction.

    (b)

    Qualifications for appointment. Members of the oversight board shall be residents of Orange County. None of the following persons shall be eligible for nomination and appointment to the oversight board:

    (1)

    Any person who has, or who had in the twelve (12) months before appointment, or who foreseeably could have in the thirty-six (36) months after appointment, any contract with the county, Orlando, or any other city in the county or any transportation agency under which the person receives sales tax proceeds;

    (2)

    Any person employed by or having any direct ownership interest in any sole proprietorship, any general or limited partnership or joint venture, or any for-profit or not-for-profit corporation or any parent or subsidiary thereof which has, or which had in the twelve (12) months before appointment, or which foreseeably could have in the thirty-six (36) months after appointment, any contract under which the entity receives sales tax proceeds from the county, Orlando or any other city in the county or any transportation agency receiving sales tax proceeds;

    (3)

    Any person employed by or having any direct ownership interest in any sole proprietorship, any general or limited partnership or joint venture, or any for-profit or not-for-profit corporation or any parent or subsidiary thereof which is frequently subject to regulation by the county, Orlando, or any other city in the county or any transportation agency receiving sales tax proceeds, and such regulation is substantially different in type and degree from regulation imposed upon the public generally; and

    (4)

    Any person who has been employed in the immediately preceding six (6) months by Orange County, any city in Orange County or any transportation agency receiving sales tax proceeds.

    (c)

    Nomination and appointment. The county chairman shall submit initial nominations to the governing board for appointment to the oversight board. The county chairman shall also submit nominations to the governing board for appointment where such appointment is necessitated by a vacancy or by a term that has expired or will expire soon.

    (d)

    Replacement of "nomination source". If the board of county commissioners finds that a source of nomination of members to the oversight board has ceased to exist or has formally declined the opportunity to nominate a member to the oversight board, the board of county commissioners shall replace the nomination source, but before doing so, the board shall provide Orlando the opportunity to suggest organizations that could represent a suitable replacement nomination source.
