§ 30-624. Miscellaneous matters.

(1)

The requirement that LOS be achieved and maintained shall not apply if proportionate share mitigation is used.

(2)

The filing of an application under this division shall be without prejudice to the right of the applicant to assert a claim of vested rights under the county vested rights ordinance; provided, however, that upon the execution of a developer's agreement, the applicant shall be deemed to have waived any rights for his project under the county vested rights ordinance.
