§ 32-183. Determination of annual rate of compensation.

(a)

Not later than July 15 each year, the board of county commissioners shall review and set the annual rate of compensation. However, the board may set the annual rate of compensation in accordance with the franchise agreements.

(b)

The board of county commissioners shall either pass a resolution fixing the rate and measure of contract compensation to be paid to the franchisee or proceed pursuant to subsection (c) below. The resolution fixing the rate and measure of contract compensation shall be effective from January through December 31 of the following year, unless the board has set the annual rate of compensation in accordance with the franchise agreements.

(c)

If the rate and measure of contract compensation for the following year is not fixed by the board prior to the hearing date in subsection (b), the monthly payment to the franchisee shall be computed in accordance with the franchise agreement.
