§ 32-193. Equipment and additional requirements.
(a)
Compliance. The franchisees and licensees shall comply with the provisions of this section.
(b)
Type of trucks.
(1)
Solid waste. The bodies of trucks used by franchisees in collecting or transportation of solid waste shall have totally enclosed beds of metal or impervious material which can be cleaned, and the beds must be reasonably watertight and leakproof. The beds shall be cleaned and disinfected regularly. The licensee shall provide adequate means as determined by the director to prevent solid waste from escaping trucks while collecting or transporting solid waste. In no event shall open-top trailers be used to collect solid waste unless specifically approved on a temporary basis by the director.
(2)
Recycling. The bodies of trucks used in the collection or transportation of recyclable materials shall have beds of metal or impervious material which can be cleaned, and the beds shall be kept clean and sanitary. The licensee shall provide adequate means, as determined by the director, to prevent recyclable materials from escaping from trucks while collecting or transporting recyclable materials.
(c)
Condition of trucks. All trucks shall be maintained in a clean and sanitary manner, and shall be mechanically sound.
(d)
Equipment required. Each franchisee and licensee shall ensure that every truck or other approved vehicle carries on a regular basis a shovel, a broom, absorbent material, a leakproof absorbent material receptacle, and a fire extinguisher, and other equipment as required by the health department or other applicable department. All trucks and auxiliary equipment will be regularly maintained in a manner necessary to prevent discharge of solid waste, automotive fluids and hydraulic fluids into the environment. All such equipment shall at a minimum meet all occupational safety and health act requirements.
(e)
Spills, accidental discharges etc. In the event of release of solid waste, recyclable materials, automotive fluids or hydraulic fluids, the following actions shall be required:
(1)
For solid waste and recyclable materials, the materials shall be immediately picked up and placed on the truck.
(2)
For automotive or hydraulic fluid, the crew of the responsible truck shall attend to the spill immediately by placing absorbent material onto the fluids. The absorbent material shall be picked up and brought to the disposal facility where the solid waste division shall determine whether the absorbent material may be disposed of as solid waste.
(3)
Remediation of all damage, including environmental damage, due to solid waste, recyclable materials, automotive or hydraulic fluid release from franchisee or licensee trucks or equipment shall be the responsibility of franchisee or licensee. Remediation shall be commenced by franchisee or licensee immediately and shall be conducted in a manner that complies with this ordinance and all local, state and federal environmental laws.
(f)
Conduct of personnel. The franchisee or licensee shall require all employees to serve the public in a courteous, helpful and impartial manner. All franchisee or licensee personnel in both field and office shall refrain from belligerent behavior and profanity. Correction of any such behavior and language shall be the responsibility of the franchisee. Personnel shall make collection with as little noise and as little disturbance to the resident as possible. No employee shall disturb or otherwise meddle with property that is unrelated to the proper execution of their duties. Care should be taken to prevent damage to property, including shrubs, flowers and other plants. Containers shall be carefully handled by the personnel and shall be thoroughly emptied and left at the premises where they are found, standing upright and with covers placed adjacent to the can at the curbside. This work shall be done in a sanitary manner and any solid waste or recyclable materials spilled by the collector shall be immediately picked up by the collector. Personnel shall not be required to expose themselves to the danger of being bitten by vicious dogs in order to accomplish collection. In any case where the owner or tenants of residential premises have such animals at large, the franchisee shall immediately notify the county's animal control department and the solid waste division of such condition and of the inability to make collection because of such condition.
(g)
Route reruns and special pickups. The director may direct a franchisee to rerun all or any part of any route when the director determines that adequate service has not been provided.
(h)
Parking in residential areas. Licensees and franchisees shall not park trucks in residential areas except for loading purposes.
(i)
Truck identification required. All franchisees and licensees shall have painted or stenciled in a prominent place on each side of every truck used in collection of solid waste or recyclable materials the telephone number of the refuse collector, the residential franchise or commercial license number of the refuse collector and, in four-inch letters, the truck number and the truck weight.
