§ 33-272. Governing board—Appointment.

  • (a)

    The governing board of the district shall consist of three (3) members, two (2) of whom shall be members of the board of county commissioners and one (1) of whom shall be a member of the city council of the City of Orlando.

    (1)

    The chairman shall be a member of the governing board; provided, however, that if the chairman declines to serve, the board of county commissioners shall appoint another of its members to serve as a member of the governing board until the chairman consents to serve.

    (2)

    The board of county commissioners shall appoint a member of the board of county commissioners representing a district encompassing all or part of the geographical area of the district to serve as a member of the governing board; provided, however, that if all members of the board of county commissioners whose district encompasses all or part of the geographical area of the district decline to serve as a member of the governing body, the board of county commissioners shall appoint another of its members to serve as a member of the governing board until one (1) of such members consents to serve.

    (3)

    The city council shall appoint a city council member representing a city council district encompassing all or part of the geographical area of the district to serve as a member of the governing body; provided, however, that if all city council members whose district encompasses all or part of the geographical area of the district decline to serve as a member of the governing board, the city council shall appoint another of its members to serve as a member of the governing board until one (1) of such members consents to serve.

    (b)

    A vacancy on the governing board shall occur by resignation of a member or by a vacancy in the seat on the board of county commissioners or city council whose member served on the governing board prior to the vacancy occurring. Upon the occurrence of a vacancy on the governing board, a new member shall be appointed to fill the unexpired term by the board of county commissioners or city council, as appropriate, using the appointment criteria set forth in subsection (a) hereof.

    (c)

    Governing board members shall serve without compensation, except that they may be reimbursed for reasonable travel and per diem expenses incurred in the course of their duties and responsibilities as governing board members. Any such reimbursement for travel or per diem expenses shall be in amounts authorized pursuant to F.S. ch. 112.

    (d)

    A quorum shall consist of two (2) members of the governing board, and official action shall be taken only upon the affirmative vote of not less than two (2) members. The governing board may adopt by-laws for election of officers and orderly proceedings.
