§ 33-274. Advisory board—Appointment.

  • (a)

    The advisory board shall consist of five (5) members, three (3) of whom shall be appointed by the board of county commissioners and two (2) of whom shall be appointed by the city council. Each member shall be either the owner of property within the district, an owner of an interest in an entity that is the owner of property within the district, an employee of a property owner or a designated representative of a property owner within the district.

    (1)

    The members first appointed shall serve terms as follows:

    a.

    Two (2) of the members appointed by the board of county commissioners shall each serve an initial term of four (4) years;

    b.

    The third member appointed by the board of county commissioners shall serve an initial term of three (3) years;

    c.

    One (1) member appointed by the city council shall serve an initial term of two (2) years; and

    d.

    The second member appointed by the city council shall serve an initial term of one (1) year.

    The first year of each initial term shall be deemed to have expired on the last day of the fiscal year during which the initial members are appointed. Thereafter, all members shall serve terms of four (4) years, except that each member shall continue to serve beyond his or her term until a successor is appointed, and the term of the successor shall be reduced by the amount of the holdover.

    (2)

    Any member may be removed by his or her appointing authority (board of county commissioners or city council):

    a.

    Because such member has ceased to be the owner of property within the district, an owner of an interest in an entity that is the owner of property within the district, an employee of a property owner or a designated representative of a property owner within the district;

    b.

    For good cause affecting his ability to perform the duties of a member; or

    c.

    For misfeasance, malfeasance or nonfeasance in office.

    (3)

    Within ninety (90) days after the occurrence or discovery of a vacancy on the advisory board, the board of county commissioners or city council, as appropriate, shall appoint a new member to serve during the unexpired portion of the term.

    (b)

    Members shall serve without compensation, except that they may be reimbursed for reasonable travel and per diem expenses incurred in the course of their official duties and responsibilities. Any such reimbursement for travel or per diem expenses shall be in amounts authorized pursuant to F.S. ch. 112.

    (c)

    A quorum shall consist of three (3) member of the advisory board, and official action shall be taken only upon majority vote of the members present and voting. The advisory board may adopt by-laws for election of officers and orderly proceedings.
