§ 35-2. Obstruction of public railroad crossings.

  • (a)

    Title. This section may be cited as the "Obstruction of Public Railroad Crossing Ordinance."

    (b)

    Scope. This section shall be effective throughout the unincorporated areas of the county.

    (c)

    Construction. The provisions of this section shall be liberally construed to effectively carry out the purpose of this section.

    (d)

    Definitions. As used in this section, the following words and terms shall have the meanings respectively ascribed:

    (1)

    Public railroad crossing shall mean any railroad crossing which is open for use by the general public without distinction.

    (2)

    Obstruct shall mean to impede, hinder, retard or delay travel or passage.

    (e)

    Prohibited. The obstruction of public railroad crossings is prohibited as follows:

    (1)

    With railroad cars, engines or trains. No railroad company, conductor, engineer or other person in charge of operating, switching or moving railroad cars, engines or trains in the unincorporated areas of the county shall permit such railroad cars, engines or trains to obstruct any public railroad crossing for a period of time in excess of fifteen (15) consecutive minutes.

    (2)

    With railroad crossing gate. No railroad company, conductor, engineer or other person who operates or controls any railroad crossing gate in the unincorporated areas of the county shall permit such railroad crossing gate to remain closed for a period of time in excess of fifteen (15) consecutive minutes.

    (3)

    Removal of obstruction. If any public railroad crossing within the unincorporated areas of the county has been obstructed by a railroad crossing gate, railroad car, engine and/or train for a period of time in excess of fifteen (15) consecutive minutes, the railroad company, conductor, engineer or other person who operates or controls such crossing gate, railroad car, engine and/or train shall cause the obstruction to be removed and the crossing to remain clear for at least fifteen (15) consecutive minutes from the time the obstruction is removed.

    (f)

    Whoever violates any subsection of this section shall be punished as provided in section 1-9.
