§ 35-66. Parking in designated areas or specified places.
(a)
The Board of County Commissioners may by resolution designate those certain described parts of streets or County-owned property for the installation of parking meters, and the same shall be established as parking meter zones. Resolution 2010-M-84 adopted by the Board of County Commissioners on November 23, 2010, designating Orange County Convention Center properties as parking meter zones is deemed to satisfy this provision.
(b)
It shall be unlawful for any person to park a vehicle in any county parking meter zone or any county lot or garage which requires payment, without paying the attendant, activating a county issued electronic parking access card, or depositing the proper amount of money in a parking meter or multi-space parking pay station or for any person to make any attempt to defraud the county.
(c)
Time limits for parking in designated parking meter zones shall be plainly marked and posted on the parking meter applicable to each such parking space or on signs conspicuously placed within that parking meter zone. Not less than ten (10) days prior to the effective date of any such time limit designation or change of designation, one (1) copy of each such designation or change of designation shall be furnished to the Sheriff's Office and one (1) copy shall be filed with the Orange County Comptroller where the same shall be available for inspection by the public.
(d)
The parking rates and the time limits for parking meter zones located at the Orange County Convention Center shall be established by the Director of the Orange County Convention Center. When so established, such rates and time limits shall be plainly marked and posted in such zones and shall be furnished to the Sheriff's Office and Orange County Comptroller pursuant to subsection (c) above.
(e)
Parking meters shall be maintained in such manner as to show or display by a signal or other method that the parking space regulated or controlled by such meter is legally in use. The parking meters and parking meter zones shall be operated and maintained in such manner as to plainly display the parking time limit, the duration of the legal parking time and the expiration of such time period for each parked vehicle and to ascertain overtime parking.
(f)
It shall be unlawful for any vehicle to be placed or remain parked in any parking meter zone space beyond the time period allowed by the appropriate manner of payment. Upon the expiration of such time such vehicle shall be considered parked overtime and a citation may be issued. A subsequent citation may be issued for each violation of the time limits provided. It shall not constitute a defense to prosecution for violation of this section that, at the time the vehicle was parked, the meter registered unexpired time. Legal parking time is that amount of time afforded by the appropriate manner of payment.
(g)
When any vehicle shall be parked in any parking meter zone, the responsible person, whether owner, operator, manager or driver of such vehicle, shall be rebuttably presumed to have adopted the parking meter device in use in such zone as a device for determining whether or not such vehicle may have remained parked in such space for a period of time longer than permitted under this chapter.
(h)
It shall be unlawful and a violation of the provisions of this Code for any person to deface, injure, tamper with, open, willfully break, destroy or impair the usefulness of any parking meter, payment center or related device in a parking meter zone.
