Division 1. GENERALLY |
§ 37-57. Intent.
(a)
The intent of this article is to:
(1)
Protect, control and conserve the quality and availability of underground water supplies in the county.
(2)
Prescribe minimum requirements governing the location, construction, and repair of wells and pump installations.
(3)
Provide for the examination, licensing, and bonding of well drillers and/or pump installers.
(4)
Forbid, where the best interests of the public would be served, the construction of new diversion facilities or wells, the initiation of new water uses, or the modification of existing uses, diversion facilities, or storage facilities within the county.
(5)
Protect the health, safety, and welfare of the public.
(b)
It is not the intent of this article to prevent property owners from constructing or repairing a well less than forty (40) feet in depth and/or installing or repairing pumping equipment situated entirely on his property for his own use, so long as the property owner complies with all provisions of this article except section 37-101 and section 37-102. It is the intent of this article to require that all wells forty (40) feet or more in depth shall be drilled and/or constructed by a county registered and licensed well contractor or by a property owner wishing to construct such a well on his property for his own personal use who meets the requirements hereinafter set forth.
