§ 37-148. Permit suspension, revocation and renewal.

  • (a)

    Utility facility permits shall be effective until suspended, revoked, surrendered or expired, and shall be subject to the provisions of these rules.

    (b)

    Failure to comply with the utilities agreement, these or any other applicable county rules shall be grounds for suspension or revocation of a utility facility permit.

    (c)

    A utility facility permit issued pursuant to these rules shall not become a vested property right in the permittee. The board of county commissioners may revoke any utility facility permit issued by it if it finds that the permit holder or his agent:

    (1)

    Submitted false or inaccurate information in his application or operation or report.

    (2)

    Has violated law, these rules, or utility facility permit conditions.

    (3)

    Has refused lawful inspection pursuant to this article.

    (d)

    Prior to sixty (60) days before the expiration of any utility facility permit, the permittee may apply for a renewal of the permit on forms and in a manner prescribed by the director. Any such renewed permit may contain modifications if such modifications are required in the opinion of the board of county commissioners to alleviate any existing violation of any federal, regional or local law, rule, regulation, permit or approval.
