§ 37-150. Variance procedures.

  • (a)

    Applications for variances from the requirements of these rules shall be made to the director, subject to county approval. The board of county commissioners may approve an application for and require of the applicant for a variance such information as is necessary to carry out the purposes of these rules.

    (b)

    The board of county commissioners may grant a variance from the terms of these rules when such variance would not be contrary to the public interest and where, owing to special conditions, a literal enforcement of the provisions herein would result in unnecessary hardship. Such variance will not be granted if it has the effect of nullifying the intent and purpose of these rules. In granting any variance, the board of county commissioners may prescribe appropriate conditions and terms thereto.
