§ 37-505. Prohibitions.

  • It shall be prohibited and shall be unlawful for any person to do any of the following acts:

    (1)

    Landspread domestic wastewater residual in the county without first obtaining a permit for such application from the county; or

    (2)

    Landspread domestic wastewater residuals that do not meet Class B, or higher stabilization as defined in F.A.C. ch. 62-640.600; or

    (3)

    Dispose of or landspread any portable toilet waste, except, into a publicly-owned treatment works ("POTW"), for which approval to do so has been received; or

    (4)

    Dispose of or landspread any domestic wastewater residual during a rain event. For purposes of this subsection, "rain event" shall encompass any precipitation and shall also include any weather conditions such as lightning, thunder or significant cloud cover or any other indicator of imminent precipitation; or

    (5)

    Landspread any raw or untreated sewage (excluding domestic septage as defined herein); or

    (6)

    Landspread or dispose of industrial or hazardous waste as defined by the applicable Florida Statutes; or

    (7)

    Directly discharge domestic wastewater residual into groundwater; or

    (8)

    Directly or indirectly discharge domestic wastewater residual into any surface water body; or

    (9)

    Apply domestic wastewater residuals prior to imminent storm event or for one (1) hour after a storm event. If there is standing water on the application site after one (1) hour or if the twenty-four-inch groundwater monitoring well(s) requirement pursuant to F.A.C. ch. 62-640-700(b) is not met, there will be no application until all water has drained from such site and the twenty-four-inch groundwater monitoring well(s) requirement is met; or

    (10)

    Dispose of or landspread any wastewater residual in a manner so as to cause a nuisance or objectionable odor.

    (11)

    Dispose of or landspread any food service sludges, unless it meets Class A stabilization as set forth in F.A.C. ch. 62-640.6001(1)(a).
