§ 37-512. Irrevocable letter of credit.

  • In addition to the permit fee, the permittee shall be required to provide an irrevocable letter of credit drawn on a local bank in the amount of five thousand dollars ($5,000.00) in favor of the county, which letter of credit shall be in compliance with applicable county administrative regulations. Proof of such irrevocable letter of credit must be submitted prior to issuance of the domestic wastewater residual application permit. The irrevocable letter of credit will be applied toward repairing road damage due to truck traffic and cleanup of any spillage associated with accidents, incidents, including abnormal events such as hurricanes, destruction by fire or wind or other cause, vandalism or emergencies or cleanup and/or removal of any domestic wastewater residual disposed of illegally or contrary to F.A.C. ch. 62-640, or this article.

    In the event a municipality is a permittee pursuant to this article, then such municipal permittee shall be exempt from the requirements of this section. The exemption shall not include subcontractors hauling for municipalities or other entities acting on behalf of municipalities.
