§ 3-38. Judical review; requirement of exhaustion of procedures.

  • (a)

    Judicial review. A decision of the hearing officer may be challenged by the licensee or Orange County in the Circuit Court for the Ninth Judicial Circuit by filing a petition for writ of certiorari with the clerk to the circuit court not later than thirty (30) days after the decision of the hearing officer has been filed with the clerk to the board of county commissioners. The complete record of the proceedings before the hearing officer, including all evidence and a complete transcript of the proceedings, shall be filed with the circuit court by the party filing the petition for writ of certiorari.

    (b)

    Requirement of exhaustion of procedures. Judicial review of a suspension or revocation shall only be available after the challenge and hearing procedures set forth in section 3-37 have been exhausted.
