§ 8-26. Authority; scope.
(a)
This article is adopted pursuant to the county's home rule authority to adopt ordinances to protect the health, safety and general welfare of the citizens of the county, and further, pursuant to F.S. § 327.60.
(b)
Boats having been declared dangerous instrumentalities pursuant to F.S. § 327.32, the board of county commissioners hereby determines that the following rules and regulations are necessary in order to protect the health, safety and general welfare of the citizens of the county using the waterways of the county.
(c)
This article shall apply to all waterways in the unincorporated and incorporated area of the county, unless exempted by general or special law or preempted by municipal ordinance.
(d)
This article shall not apply to boats, motorboats or skiers performing in or used in shows, exhibitions or tournaments operated by and at a theme park or other amusement park. The operators of the theme park or amusement park shall be responsible for the safe operation and equipping of all boats, motorboats and skiers at such shows, exhibitions or tournaments.
