§ 9-322. Definitions.

  • (a)

    Advertisement shall be defined to include any announcement, listing, display, entry or other written or printed statement of whatever nature or kind, and specifically to include a name and address or telephone number placed under a heading when the heading describes or encompasses services regulated by F.S. ch. 489 or the county or local authority.

    (b)

    Building permit means any permit issued by Orange County through its division of building safety for construction work, electrical work, plumbing work, or other construction trades work as regulated and authorized by Orange County Code chapter 9, building and construction regulations.

    (c)

    Certificate means a certificate of competency issued by the county or local authority or the State of Florida, Department of Business and Professional Regulation, Construction Industry Licensing Board or the electrical contractor's licensing board or authorized contractor licensing boards.

    (d)

    Certification means the act of obtaining or holding a certificate of competency from the county or local authority or the State of Florida, Department of Business and Professional Regulation, Construction Industry Licensing Board or the electrical contractor's licensing board or other authorized contractor licensing boards.

    (e)

    Contractor shall mean and refer to any person who undertakes to, or submits a bid to, or does himself or herself or by others, construct, repair, alter, remodel, add to, subtract from, demolish, move or improve any building or structure, including related improvements to real estate, for others, or for resale to others, or who undertakes or offers to undertake or purports to have the capacity to undertake, or submits a bid to, or agrees under contract, or does himself or herself, or by or through others, engages in trade or occupation regulated by chapter 9, Orange County Code, this article, a local authority ordinance or F.S. ch. 489.

    (f)

    County shall mean the County of Orange County, Florida.

    (g)

    Licensed means possessing the certificates required pursuant to F.S. ch. 489 and/or chapter 9, Orange County Code, this article or any applicable local authority ordinance authorizing the licensing of contractors.

    (h)

    Licensed contractor means any contractor who possesses a certificate of competency issued by the county or local authority and is licensed by the State of Florida, Department of Business and Professional Regulation, Construction Industry Licensing Board or the electrical contractor's licensing board.

    (i)

    Local authority means any and all municipalities located within the legal boundaries of Orange County, Florida.

    (j)

    Person shall have the meaning provided in section 1-2, Orange County Code.

    (k)

    Primary qualifying agent shall mean a person who possesses the requisite skill, knowledge, and experience, and has the responsibility, to supervise, direct, manage, and control the contracting activities of the business organization with which he or she is connected, who has the responsibility to supervise, direct, manage, and control construction activities on a job for which he or she has obtained the building permit; and whose technical and personal qualifications have been determined by investigation and examination as provided for in F.S. ch. 489.

    (l)

    Registered contractor means any contractor who has registered with the State of Florida, Department of Business and Professional Regulation pursuant to fulfilling the competency requirements of the county or local authority.

    (m)

    Repeat violation shall mean a recurring violation of a provision of this article by a violator whom Orange County has previously found to have violated the same provision or a violator against whom penalties were assessed for the same provision, within five (5) years prior to the violation.

    (n)

    Sign specialty contractor, non-electrical contractor shall mean a person who is qualified pursuant to a certificate of competency to structurally fabricate, erect, install, alter, repair, assemble, or change non-electric signs according to the building code, but not to engage in any electrical wiring.

    (o)

    Specialty contractor means any contractor who possesses a license and/or registration required by the county and/or local authority that is not a requirement under F.S. ch. 489.
