§ 15-71. Violations; penalties and remedies.

  • (a)

    Generally. It shall be unlawful for any person to violate any provision of this article, or any provision of any regulation enacted pursuant to the authority of this article, or any term or condition of any permit issued pursuant to the authority of this article. Each day such violation continues shall be considered a separate offense. In addition, if the local firefighting authority having jurisdiction confirms that a fire, that was in violation of any provision of this ordinance, was extinguished, and subsequently a fire occurs on the same property in violation of this ordinance on the same day or thereafter, such violation shall be considered a separate offense. Violations of the provisions of these rules or failure to comply with any of the requirements set forth herein shall be prosecuted as provided by Laws of Fla. ch. 67-1830, as amended, and this chapter.

    (b)

    Code enforcement. Any person who violates this article, or any provision of any regulation enacted pursuant to the authority of this article, may be prosecuted in accordance with chapter 11. Violations of this chapter, or any provision of any regulation enacted pursuant to the authority of this article, may be punished as provided in section 1-9.

    (c)

    DEP enforcement remedies. The county may avail itself of the enforcement provisions available to DEP under F.S. ch. 403, including F.S. § 403.121 (2015), and the rules adopted by reference in this ordinance.

    (d)

    Other relief. Nothing herein contained shall prevent the environmental protection officer or the county from taking such other lawful action as is necessary to prevent or remedy any violation, including seeking injunctive relief in a court of competent jurisdiction.

    (e)

    Enforcement costs. Any person violating this article shall be liable for all costs incurred by the county in connection with enforcing this article or any provision of any regulation enacted pursuant to this article, including without limitation, the costs incurred by the local firefighting authority having jurisdiction responding to any incident, attorneys' fees and investigative and court costs.
