§ 16-3. Definitions.

  • The following words, terms and phrases, when used in this chapter, shall have the meanings ascribed to them in this section, except where the context clearly indicates a different meaning:

    Conservation area shall mean a conservation area as defined in the standards established by the Orange County conservation ordinance.

    County engineer shall mean a professional engineer retained by the board of county commissioners as deputy director of the public works division. The term "county engineer" within this chapter may be either the county engineer or his designated representative.

    Environmental protection manager shall mean an individual retained by the board of county commissioners as manager of the environmental protection department. The term "manager" within this chapter may be either the manager or his designated representative.

    Excavation shall mean an operation in which materials, including, but not limited to, earth, rock, muck, concrete rubble or other mass of material, in or on real property are moved, removed or otherwise displaced by any artificial means, including, but not limited to, tools, equipment or explosives, for or during operations, where the aforementioned material is to be relocated or used at a place or places other than its natural site. An excavation may include a soil-cement batch plant, if approved as part of the excavation permit.

    Fill shall mean an operation in which off-site, imported material, as classified herein, is deposited in or on real property by artificial means in order to raise the existing ground surface elevation, or to meet the proposed grade of construction plans approved by the county, including, but not necessarily limited to, commercial and/or subdivision development, or to stockpile excess material on a site other than the site from which the material is removed. The only other fill operation authorized under the provisions of this chapter is excavation of unsuitable material, and the filling of such a site with approved fill material. Fill shall be classified into the following types:

    (1)

    Type I material consists of compacted earth free of roots and other vegetable matter.

    (2)

    Type II material consists of clean debris, which means any solid waste which is virtually inert and which is not a pollution threat to groundwater or surface waters and is not a fire hazard, and which is likely to retain its physical and chemical structure under expected conditions of disposal or use. The term includes brick, glass, ceramics and uncontaminated concrete including embedded pipe or steel. If this type material is to be used, a layering plan must be submitted and approved by the county engineer. Mixing of type II debris with other wastes will cause it to be classified as other than type II material.

    Mass grading shall mean the movement of earth from one (1) location to another entirely within the boundaries of a project after preliminary subdivision plan approval has been obtained but prior to approval of the construction drawings.

    Restoration shall mean the fulfillment of provisions of this chapter regarding finished side slopes of no greater than five (5) to one (1) and establishment of a dense stand of grass thereon, and planting of trees pursuant to chapter 15, article VIII, of the Orange County Code.

    Soil-cement batch plant shall mean a facility which produces an end product that is uniformly mixed and moistened for use as a road base material. Such a facility is composed of five (5) principal parts:

    (1)

    A hopper bin for natural soil;

    (2)

    A silo for portland cement;

    (3)

    A metered water supply;

    (4)

    A conveyor belt;

    (5)

    A mixer with a discharge chute.

    Surety shall mean a letter of credit, or cash escrow deposit in an amount as may be prescribed from time to time by separate resolution or by the public works director, to ensure that the permitted project is completed and restored in accordance with county regulations and the approved plans.
