§ 17-102. Findings and intent.

  • (a)

    Pursuant to Fla. Const. art. VIII, § 1 and laws of the state, the board of county commissioners has broad home rule powers to carry on county government. To the extent not inconsistent with general and special law, the board of county commissioners may provide and maintain county buildings, borrow and expend money, issue obligations of indebtedness, enter into contractual obligations, purchase or lease and sell and exchange real and personal property, and exercise all powers and privileges not specifically prohibited by law.

    (b)

    The board of county commissioners is expressly authorized by F.S. § 125.031 to enter into leases and lease-purchase arrangements relating to properties needed for public purposes in accordance with the provisions of that section. Also, the board of county commissioners is expressly authorized by F.S. § 125.35 to lease county-owned property.

    (c)

    In the judgment of the board of county commissioners, it is necessary for the public health, safety and general welfare of the county and its citizens to provide for the financing, acquisition and construction of capital projects which serve a county purpose, and for the refunding of obligations of the county or of the Orange County Civic Improvement Corporation issued to finance or refinance any such capital projects.

    (d)

    The board of county commissioners finds that certain non-ad valorem fund revenues which are legally available to the county are an appropriate source of revenue to pledge for financing such projects and refundings.

    (e)

    The board of county commissioners finds that the use of bonds issued by a nonprofit corporation or by the county is a proper and efficient method to finance the acquisition of capital projects, particularly county buildings, in the manner contemplated by this division.

    (f)

    The board of county commissioners intends this division to serve as authority for the financing contemplated below and to supplement the express powers granted by Florida Statutes. If and when any conflict occurs between this division and general or special law, the latter shall govern.
