§ 21-131. Petition by property owners; performance of work by county employees; payment of costs.

  • Upon petition signed by the owners of sixty-six and two-thirds (66 2/3 ) percent of the real estate and frontage described in such petition as property to be specially benefited, which real estate shall be regarded as a district and may be that which abuts upon the line of the proposed improvements, requesting the board of county commissioners to grade, pave, curb or gutter any continuous portion of a single highway or street, or two (2) or more connecting highways or streets, or to make two (2) or more such improvements, by assessment of the entire cost thereof against the abutting property or such portion of the cost as the board of county commissioners may designate, the board of county commissioners may, in its discretion, upon a finding by the board of county commissioners that the petition is sufficient in form, substance and execution, order such improvements to be made and specially assess against the abutting property that portion of the cost that the board has designated, and pay as a county charge any remaining cost. If the board of county commissioners finds that it is in the best interest of the county to have such improvement performed by county employees using county materials, such improvement shall be ordered performed by county employees using county materials, and the cost of such improvement shall be assessed as provided herein. All assessments for improvements made pursuant to this section shall be payable in accordance with this article.
