§ 21-238. Safety and convenience.

  • (a)

    The safety provisions of applicable laws, ordinances, building codes and construction codes shall be observed. Machinery, equipment and other hazards shall be guarded in accordance with the safety provisions of the Manual of Accident Prevention in Construction published by the Associated General Contractors of America, to the extent that such provisions are not in contradiction with applicable laws.

    (b)

    The permittee will take all reasonable precautions for and be responsible for initiating, maintaining and supervising all programs relating to the safety of all persons and property affected by or involved in the performance of his work under a right-of-way utilization permit. The permittee will take all reasonable precautions to prevent damage, injury or loss to:

    (1)

    All persons who may be affected by the performance of his work, including employees.

    (2)

    All materials and equipment at the work site location.

    (3)

    All property at or surrounding the work site.

    In any emergency affecting the safety of persons or property, the permittee will act with reasonable care and discretion to prevent any threatened damage, injury or loss.
