§ 2-191. Creation; organization.

  • (a)

    The Enterprise Zone Development Agency is hereby created.

    (b)

    The Orange County Enterprise Zone Development Agency shall be governed by a nine-member board of commissioners. The nine-member board of commissioners may be, but is not required to be, appointed from the following categories with certain members, as specified, selected from areas within the boundaries of the areas nominated for Enterprise Zone status:

    (1)

    Two (2) residents of the Orange County and/or South Apopka Enterprise Zone area;

    (2)

    Local businesses and when possible businesses operating within an Enterprise Zone area;

    (3)

    Nonprofit community-based organization operating within an Enterprise Zone area;

    (4)

    Local financial or insurance institution representative;

    (5)

    Local chamber of commerce member;

    (6)

    Workforce development board representative;

    (7)

    Local code enforcement agency representative;

    (8)

    Orange County Sheriff's Office representative; and

    (9)

    Representatives from another economic development, business development, or community development organizations.

    The importance of including individuals residing in or operating a business in the Enterprise Zones shall be considered when making appointments.

    (c)

    The terms of office of the commissioners shall be for four (4) years, except the board of county commissioners, in making the initial appointments, shall appoint two (2) commissioners for a term of three (3) years, two (2) commissioners for a term of two (2) years and one (1) commissioner for a term of one (1) year.

    (d)

    A vacancy occurring during a term shall be filled for the unexpired term. Each commissioner shall hold office until a successor has been appointed and has qualified. A certificate of the appointment or reappointment of any commissioner is conclusive evidence of the due and proper appointment of the commissioner. The clerk of the county shall send a copy of each such certificate to the State of Florida Office of Tourism, Trade and Economic Development (OTTED).

    (e)

    The powers of the enterprise zone development agency shall be exercised by the commissioners. A majority of the commissioners constitutes a quorum for the purpose of conducting business and exercising the powers of the agency and for all other purposes. Action may be taken by the agency upon a vote of a majority of the commissioners present, unless in any case the bylaws require a larger number.

    (f)

    The board of county commissioners shall designate the initial chair and vice chair of the enterprise zone development agency.

    (g)

    The board of county commissioners may remove a commissioner for inefficiency, neglect of duty, or misconduct in office only after a hearing and only if the commissioner has been given a copy of the charges at least ten (10) days prior to the hearing and has had an opportunity to be heard in person or by counsel.
