§ 37-29. Grant of franchise; terms, conditions; forfeiture.

  • In the event the board of county commissioners shall determine to grant the franchise requested, the board of county commissioners shall do so upon such reasonable terms and conditions as it shall consider for the best interest of the community where such facility is proposed to be installed. All franchises issued pursuant to the provisions of this article shall provide that in the event such franchise holder shall violate any of the terms, conditions or provisions of such franchise, or any rule or regulation imposed by the state board of health, for a period of thirty (30) days after having been notified in writing by the board of county commissioners or its authorized agent, to desist from such violation, then the holder of the franchise shall be deemed to have forfeited the same and such forfeiture may be so declared by a judge of the circuit court of the county in such manner and form as is now or may in the future be provided by law for the forfeiture of municipal franchises.
