Article XVI. DOMESTIC WASTEWATER RESIDUAL MANAGEMENT |
§ 37-508. Same—Application for permit.
Any person who disposes of domestic wastewater residual in the county must first submit an application containing the following elements, at a minimum, to the division:
(1)
A copy of the following, as may be applicable pursuant to F.A.C. ch. 62-640:
a.
DEP "Agricultural Use Plan."
(2)
A letter from the landowner authorizing domestic wastewater residual application on his/her property and granting access to county employees for inspections.
(3)
An irrevocable letter of credit, unless previously submitted, in the amount of five thousand dollars ($5,000.00).
(4)
Proof of two hundred fifty thousand dollars ($250,000.00) liability insurance, evidenced by a certificate of insurance requiring thirty (30) days notice to the county in the event of cancellation, for the domestic wastewater residual hauler.
(5)
Notice of the proposed landspreading shall be posted at all entrances to the proposed land application site abutting federal, state or county roads, easements, right-of-ways or otherwise directed by the division. A map/schematic with the names and mailing address of the owners and the occupants (or their authorized agents) of buildings located within one thousand (1,000) feet of the land application site (the area within the lot or parcel whereon the proposed landspread application is proposed to occur) is required. In addition, notification in a publication of general distribution must be made for seven (7) consecutive days advertising the intended land application of domestic wastewater residuals. The applicant shall provide written assurance that the required notification has been accomplished. If no objection or response is received by the division within thirty (30) days of notification and posting of notice on the proposed land application site and the division certifies that the application is deemed complete, processing of the application will proceed. If an objection is received within the prescribed time period, then a public hearing before the board of county commissioners will be scheduled to address the issues. The board of county commissioners shall then make the final decision for approval/disapproval at the next available public hearing.
