§ 37-509. Permit application review and issuance.

  • (1)

    Subject to subsection 37-508(5), upon receipt of a permit application and upon determination that the application contains the required elements (including meeting the notice requirements of section 37-508 herein) and is complete, the environmental protection officer or designated representative shall have thirty (30) days to either approve, approve with conditions or deny the permit application.

    (2)

    The application will be reviewed for compliance with the application criteria of F.A.C. ch. 62-640 and this article. The environmental protection officer or his/her designated representative shall have the authority to impose specific conditions on the permit which are necessary to mitigate anticipated negative environmental impacts associated with the application activity.

    (3)

    Specific conditions may be, but are not limited to:

    (a)

    Topographical setbacks;

    (b)

    Limitation of land application based on soil types and historical groundwater table fluctuations;

    (c)

    Setbacks based on population densities; and

    (d)

    Limitations on types of agricultural practices.
