Article XVII. INDIVIDUAL ON-SITE SEWAGE DISPOSAL |
§ 37-533. Definitions.
For the purpose of this article, the following words and phrases shall have the meanings indicated:
Absorption surface shall mean the total surface area of soil at the bottom of the soil absorption system drainfield.
Applicant shall mean any person who submits documents for an OSDS permit pursuant to these regulations.
Approved shall mean an OSDS permitted, constructed and installed in compliance with technical standards and requirements of this article. "Approved" installation does not imply that a system will perform satisfactorily for a specific period of time.
Available shall mean within the service area of Orange County, a city or Florida Public Service Commission (F.P.S.C.) certificated central sewerage system shall be deemed available for the connection of the building plumbing if all of the applicable following requirements are met:
(1)
The sewerage system is not under moratorium issued by the Florida Department of Environmental Regulation or other governmental entity having jurisdiction.
(2)
The sewerage system has adequate hydraulic capacity to accept the quantity of sewage to be discharged by the proposed establishment.
(3)
The owner of the sewerage system will permit a connection to the system and the property is within the system's service area.
(4)
For single-family residences or for estimated sewage flows of six hundred (600) or less gallons per day, a sewerage system shall be considered available if a gravity sewer line exists in an easement accomodating public utilities or rights-of-way which abuts the property, and if gravity flow can be maintained from the building drain to the gravity sewer line or lift station.
(5)
For estimated sewage flows exceeding six hundred (600) gallons per day, a sewerage system shall be considered available if a gravity sewer line, force main, or lift station exists in a public easement or right-of-way which abuts the property or is within one hundred (100) feet of the property as measured along and accessible via an easement accommodating public utilities or rights-of-way.

For areas zoned or used for industrial or manufacturing purposes or its equivalent, a sewer line existing within one-quarter (¼) mile of the development as measured along and accessible via an easement accommodating public utilities or right-of-way shall be considered available. For repair or modification purposes, available sewers are any sewer lines within five hundred (500) feet of the building sewer stubout as measured along and accessible via an easement accommodating public utilities or rights-of-way.
(7)
For subdivisions approved after the effective date of Ordinance No. 92-16, a gravity sewer line, force main, or lift station within one (1) mile of the site shall be considered available. One (1) mile shall be measured from the property line along the most direct path within the public right-of-way or easement in which the sewer line would be installed using normal construction practices.
Bedroom shall mean a room designed primarily for sleeping, containing a closet.
Board shall mean the board of county commissioners of Orange County, Florida.
Domestic sewage waste shall mean human body waste and wastewater, including bath and toilet waste, residential laundry waste, residential kitchen waste and other similar waste from household or establishment appurtenances. Domestic sewage wastes are further categorized as:
(1)
Blackwater: waste carried off by toilets, urinals, and kitchen drains.
(2)
Graywater: all domestic waste not covered in (1) above and including bath, lavatory, laundry and sink, except kitchen sink waste.
Drainfield shall mean a system of open-jointed or perforated piping, approved alternative distribution units or other treatment facilities designed to distribute effluent for filtration, oxidation and absorption by the soil within the zone of aeration.
Dwelling unit shall mean a residence for the housing of a single family whether such residence is a detached structure or a unit of a multiple-family building.
Elevated system shall mean a drainfield constructed at a prescribed elevation in a prepared area of fill material. Any drainfield system in which any part of the bottom surface of the drainfield trench or absorption bed is located at or above the elevation of surrounding finished lot grade in the drainfield area must be considered an elevated system.
Geotechnical engineer shall mean a registered Florida engineer who provides services related to terrain evaluation and site selection; subsurface exploration and sampling; determination of soil and rock properties; foundation engineering; settlement and seepage analysis; design of earth and earth retaining structures; as well as the design of subsurface drainage systems and the improvement of soil properties and foundation conditions.
Health department shall mean the Health and Rehabilitative Service Orange County Public Health Unit/Environmental Health.
Heated or cooled area shall mean that enclosed area of a dwelling unit, excluding the garage, carport, exterior storage shed, open or fully screened patios or decks, which is heated, cooled, or ventilated by mechanical systems, including fan devices, designed to control or modify indoor temperature.
Individual on-site sewage disposal system (OSDS), also referred to as septic system shall mean any domestic sewage treatment and disposal facility, including standard subsurface or mounded drainfield systems, graywater systems, laundry wastewater systems, pretreatment tanks, grease traps, grinder pumps and sump pumps, alternative systems or experimental systems, installed or proposed to be installed beyond the building on land of the owner or on other land to which the owner or owners have the legal right to install a system.
Industrial, hazardous or toxic sewage waste shall mean wastewater not otherwise defined as domestic sewage waste or any wastewater not similar in composition or concentration to domestic sewage wastes. The following is a representative sample, not an exhaustive list, of generators of such wastewater: wastewater carried off by floor drains located in buildings in industrial or manufacturing areas; total wastewater flows exceeding three thousand (3,000) gallons per day from commercial or institutional food establishments; and any wastewater from facilities or establishments, such as but not limited to commercial laundry facilities, funeral homes, car washes, photo labs, medical facilities and/or offices, dental facilities and/or offices, and veterinarian facilities and/or offices which by their nature utilize various chemicals and/or compounds either not normally found in or are found only in low concentrations in domestic sewage waste.
Normal high water elevation shall mean the landward edge of any natural surface water body during a normal hydrological condition as determined in accordance with Orange County Code, chapter 30, article IX.
Obstructed land shall mean those areas on a lot or property which are used for such purposes as pools, concrete slabs, buildings, driveways, parking and similar areas which would prohibit, hinder or affect the installation, operation or maintenance of an OSDS.
Private potable water well shall mean a well used only by a private home, or multiple-family type building of four (4) dwelling units or less which are not rental units.
Public potable water well shall mean a well serving any potable water system other than a private potable water system.
Septic tank shall mean a watertight receptacle constructed to promote separation of solid and liquid components of wastewater, to provide limited digestion of organic matter, to store solids, and to allow clarified liquid to discharge for further treatment and disposal in a soil absorption system.
Subdivision shall mean any division of land as defined in Laws of Florida, ch. 65-2015.
Surface water body shall mean a natural or manmade depression which, under normal climatological conditions, contains water throughout the year. This shall not include engineered retention/detention ponds designed pursuant to the land development code which are not intended to be treated as an amenity for the development.
Swale shall mean a manmade trench which contains contiguous areas of standing or flowing water for only a brief period following a rainfall event.
Water table elevation shall mean the upper surface of the groundwater or that level below which the soil or underlying rock material is wholly saturated with water.
Wet season shall mean that period of time each year in which the groundwater table elevation can normally be expected to be at its highest elevation.
