§ 19-93. Specific standards for A Zones without base flood elevations and regulatory floodways.

  • Located within the areas of special flood hazard established by this chapter, where there exist A Zones for which no base flood elevation data and regulatory floodway have been provided or designated by FEMA, the following provisions shall apply in addition to the standards set forth in sections 19-91 and 19-92:

    (1)

    No encroachments, including fill material or structures, shall be located within a distance of a stream bank equal to five (5) times the width of the stream at the top of bank or twenty (20) feet each side from top of bank, whichever is greater, unless certification by a Florida registered professional engineer is provided demonstrating that such encroachments shall not result in any increase in flood levels during the occurrence of the base flood discharge.

    (2)

    All residential, commercial, or industrial subdivision proposals (including proposals for manufactured home parks and subdivisions), shall establish the base flood elevation to the satisfaction of the floodplain administrator. For all other proposed development, the floodplain administrator shall obtain, review and reasonably utilize any base flood elevation and floodway data available from any other source, in order to administer the provisions of this chapter. When such data is utilized the floodplain administrator shall:

    a.

    Obtain the elevation (in relation to mean sea level) of the lowest floor (including basement) of all new and substantially improved structures;

    b.

    Obtain, if the structure has been floodproofed in accordance with subsection 19-92(2), the elevation (in relation to mean sea level) to which the structure has been floodproofed; and

    c.

    Maintain a record of all such information.

    (3)

    Notify, in riverine situations, adjacent communities, the Florida Department of Community Affairs - NFIP Coordinating Office, the South Florida Water Management District, and/or the St. Johns River Water Management District, prior to any alteration or relocation of a watercourse, and submit copies of such notifications to FEMA.

    (4)

    Assure that the flood-carrying capacity within the altered or relocated portion of any watercourse is maintained.

    (5)

    Manufactured homes shall be installed using methods and practices that minimize flood damage. They must be elevated and anchored to resist flotation, collapse, or lateral movement. Methods of anchoring may include, but are not to be limited to, use of over-the-top or frame ties to ground anchors. This requirement is in addition to applicable State of Florida and local anchoring requirements for resisting wind forces.

    (6)

    When the data is not available from any source, in accordance with the standard set forth in subsection (2) above, the lowest floor of the structure shall be elevated to no lower than three (3) feet above the highest adjacent grade.
