Article XVI. DOMESTIC WASTEWATER RESIDUAL MANAGEMENT |
§ 37-504. Definitions.
For the purpose of this article, words used in the singular shall include the plural, and the plural the singular; words used in the present tense shall include the future tense. The word "shall" is mandatory and not discretionary. The word "may" is permissive. Words not defined herein shall be construed to have the meanings given by common and ordinary use as defined in Webster's Ninth New Collegiate Dictionary.
Any citation to a specific provision of the Florida Administrative Code or Florida Statutes is intended to apply to any amendment or replacement of the cited provisions which is made subsequent to March 9, 1992.
Any time period referenced herein shall include Saturdays, Sundays and legal holidays.
Class AA sludge means a domestic wastewater residual meeting the criteria set forth in F.A.C. ch. 62-640.850.
Class A sludge means domestic wastewater residual meeting the criteria set forth in F.A.C. ch. 62-640.600(1)(a).
Class B sludge means domestic wastewater residual meeting the criteria set forth in F.A.C. ch. 62-640.600(1)(b).
DEP means the State of Florida, Department of Environmental Protection.
Division means the Orange County Environmental Protection Division, formerly known as the Environmental Protection Department, or any successor department or division.
Domestic septage means the liquid and solid material pumped from a septic tank, holding tank or similar domestic sewage treatment or holding system when the system is cleaned or maintained, but shall not include any manufactured or manmade item or product or portable toilet waste.
Domestic wastewater residual, for the purpose of this article, means any wastewater sludge which is generated by a domestic wastewater treatment plant or related operation including, but not limited to domestic septage as defined herein. The material may be either solid, liquid or semisolid. Domestic wastewater residual does not include treated effluent from a wastewater treatment plant or any manufactured or manmade product or item.
F.A.C. means the Florida Administrative Code, an annotated official compilation of the rules and regulations of the State of Florida, published by the Florida Secretary of State.
Food service sludge means oils, greases and grease trap pumpings generated in the food service industry.
Nuisance or objectionable odor. Objectionable odors or other nuisance conditions shall be construed to be an odor from a domestic wastewater residual application site if such odor can be detected by the county inspector, at the property boundaries as set forth in section 37-505, and the odor is not determined to be originating from another source by the county inspector.
Person shall mean any individual, association, partnership, corporation or other entity, including any officer, employee, department, agency or instrumentality of the United States, the state or any political subdivision thereof.
Stabilization means a treatment process which renders domestic wastewater residual less odorous or less putrescible, or both, and which reduces the pathogenic content and vector attraction of the material as defined in F.A.C. ch. 62-640.600.
